Contractual Terms & Conditions

These Terms & Conditions (“Terms”) form an integral part of the design services agreement (“Agreement”) between Jablanc Interiors and the Client.

 

1. Scope of Services
Jablanc Interiors (“the Designer”) shall provide the services outlined in the proposal or agreement, which may include: design consultation, concept development, space planning, materials selection, and project coordination. Any service not explicitly listed shall be subject to a separate agreement or additional charge.

2. Project Timeline
Timelines provided are estimates and may be adjusted due to supplier delays, material availability, or changes requested by the Client.

3. Payment Terms
A non-refundable deposit of 20% is required to initiate work. Further payments are due according to project milestones. Late payments are subject to a 1.5% monthly interest. Final payment must be received before project handover.

4. Revisions
Three (3) rounds of design revisions are included in the proposal. Additional revisions may be charged at RM300 per drawing at a fixed rate.

5. Procurement
The Designer may assist in procuring materials and furnishings. The Designer is not responsible for delays or defects from third-party suppliers.

6. Site Access and Safety
The Client must provide timely access and a safe working environment. Delays due to limited access or unsafe conditions may result in timeline adjustments and additional fees.

7. Intellectual Property
All designs, drawings, and concepts remain the sole property of Jablanc Interiors unless otherwise agreed in writing. Unauthorized reproduction or use is prohibited.

8. Cancellation and Termination
Either party may terminate the Agreement with 7 days’ written notice. The Client remains liable for work completed and costs incurred. Deposits are non-refundable.

9. Limitation of Liability
The Designer shall not be liable for third-party acts, delays from external factors, or post-handover damages. Liability is limited to total fees paid under this Agreement.

10. Governing Law
This Agreement is governed by the laws of Malaysia. For Singapore projects, applicable provisions of Singapore law may also apply.
